RefOEarn – Terms & Condition

These terms and conditions govern the RefOEarn Program of Home Credit India Finance Private Limited, having its registered office at 3rd Floor, Tower C, DLF Infinity Towers, DLF Cyber City Phase II, Gurgaon, Haryana (“HCIN”) and you, as “Participant ”, agree that your participation in this program constitutes your understanding and agreement to these terms and conditions. You also agree that your participation is subject to the Terms of Use and you understand that your personal information will be processed as described in the Privacy Policy.

 

A. RefOEarn Program
1. RefOEarn Program is reward based program, wherein the registered Participant can refer their friends, family and contacts (“lead”) for HCIN loan(s) and earn conversion fee in accordance with the terms mentioned in section “C” below.
2. The Participant can refer the lead and participate in the program through this application only. The RefOEarn Program can be discontinued anytime at the sole discretion of HCIN.

 

B. Eligibility
1. Participant must be of 18 year of age or older and is competent to contract as per laws applicable in India.
2. Participant must be an Indian Citizen or resident national.
3. Participant must have a Paytm KYC complied account to receive the conversion fee.

 

C. Payment Terms
1. Subject to the Terms and Conditions of this RefOEarn Program, Participant will be eligible for the conversion fee for each lead, which shall be communicated to the Participant separately, on meeting following conditions:
(i) The lead should be referred by Participant.
(ii) The lead must use link sent in message by Participant to (i) download HCIN application from play-store or (ii) call HCIN inbound number to know various offers form HCIN.
(iii) The loan of the referred lead must be approved and successfully disbursed by HCIN.
(iv) Lead must repay first three EMI’s (Equated Monthly Instalments) to HCIN.
 (v) f there is a lead who is referred by two Participants, clicked first on Participant “A” link, couple of hours later click on Participant “B” link and thereafter gets the loan or services offered by HCIN, then in this circumstance, Participant “A” shall be eligible to get the ‘conversion fees’.
2. Payment of conversion fees shall be calculated at month end and the same will be transferred to Paytm account provided by the Participant on monthly basis.
3. Paytm number provided by the Participant for payment of conversion fee shall be responsibility of Participant. If Paytm number entered is incorrect then HCIN shall not be liable for the Participant not receiving the conversion fee.
4. In case the Participant is HCIN employee the conversion fee shall be part of Participant other incentives received from HCIN.
5. TDS (Tax Deducted at Source) shall be deducted as per applicable rate from the conversion fees payable to the Participant. At present the TDS rate is 5% in case Participant provides the PAN and 20% in case Participant doesn’t provide PAN to HCIN.

 

Other Conditions
1. Participant shall obtain the consent of the lead before referring it to HCIN for loan and services provided by HCIN. HCIN shall not be responsible for any complaint received from the Telecom Regulatory Authority of India (TRAI) for any unsolicited and unwarranted communication done by Participant to the lead. Participant shall reimburse HCIN for any and all penalties, costs or damages incurred in relation to Participant’s breach of obligations under this paragraph.
2. For the purpose of the RefOEarn Program, Participant provide express permission to HCIN to access Participant contacts, messages, calling history available on Participant’s mobile device.
3. Upon Participant’s consent, the Participant’s contacts information shall be synced with HCIN mobile application. Post such sync, the Participant would be able to view its contact list on the HCIN App while sharing the referral communication with his/her contact list.
4. The email address or the phone number that will be used by Participant for creating the Participant account must belong to Participant.
5. The charges for SMS and data used for sending any communication to the leads while participating in this RefOEarn Program shall be solely borne by the Participant as per the rates and charges applicable by the Participant’s respective telecom network provider.
6. HCIN will not be responsible for any loss or damage caused to the Participant if the RefOEarn Program is cancelled and/or withdrawn by HCIN or if the Participant is not able to participate in the RefOEarn Program due to any reason whatsoever.
7. Participant shall share any information including its KYC information as may be required by HCIN time to time. Participant shall also ensure to originally verify such information at a time or place as may be communicated by HCIN, failing which HCIN reserves the rights to suspend the Participant account and withhold the payment of conversion fee till such time the Participant has not complied with the requirement of HCIN.
8. HCIN may, in its sole judgement, disqualify Participant to prevent actual or suspected abuse of the RefOEarn Program, including but not limited to fraud, illegal or prohibited acts, spamming to leads, or other misuse (collectively, “Abuse”). HCIN may upon notice of such Abuse temporarily or permanently suspend the access to the RefOEarn Program, and/or reject or cancel specific reward/ conversion fee. HCIN may monitor Participant’s use of the RefOEarn Program to detect Abuse and share Participant’s usage information with third party providers to assist in these efforts.
9. Any claims or disputes arising out of these RefOEarn Registration conditions shall be governed by Laws of India and under the exclusive jurisdiction of the Courts of Gurugram, Haryana.
